Terms and Conditions

  1. The use of the Therabox product implies full and unreserved acceptance of all the provisions included in these Terms and Conditions of Use, as well as in the Privacy Policy of Therabox, a product belonging to the company Bethera.
  2. Bethera reserves the right to change the Terms and Conditions and the Privacy Policy from time to time, so the User should consult the current documents before using the service. If you do not fully agree with their provisions, you should not use the service.
  3. Any functionality that changes, improves or enhances the current service, including the launch of new tools, is subject to the conditions set out in the Terms and Conditions and the Privacy Policy;
  4. Breach of any of the conditions set out in the Terms and Conditions entitles Bethera to terminate the contract and prevent the user from using the service.


RESPONSIBILITY

  1. The User undertakes to ensure that all the information provided is true, accurate, complete and not misleading in any material respect, to use the service exclusively for the purposes described in this contract and to inform the Therabox team of any facts and/or circumstances that place or may affect, in any way, their rights or the rights of third parties, copyright or otherwise.
  2. The User undertakes to make every effort, always acting with the utmost diligence when using the service, in order to fulfill the purposes of this agreement and not to denigrate Therabox.
  3. The User understands and agrees that Bethera cannot be held responsible for any content inserted and displayed during the use of the service.
  4. Bethera does not recognize and cannot be held responsible for errors or delays that may occur due to errors attributable to the User or the system or failure (temporary or permanent) of the applications or other tools, any loss of data, delays or any other circumstance or fact attributable to third parties or the Internet that may affect access to and/or development of the service, and shall not be held responsible for any damages resulting from the use or impossibility of use.
  5. Bethera is not responsible for any errors that the User or their collaborators may make when providing their personal data and, in particular, is not responsible for errors that may occur in the service when they are the result of incorrect, incomplete or erroneous indication of the data requested from the User.
  6. Bethera cannot be held responsible for any loss or damage resulting from undue access by third parties, and the User acknowledges that Therabox is fully equipped with all the appropriate, suitable and adequate security means to protect their data, and the User undertakes not to compromise the security of the system through negligent, incorrect or inappropriate use of the system and services.
  7. The User expressly understands and agrees that Bethera cannot be held liable under any circumstances for any direct, indirect, pecuniary or non-pecuniary damages, except in the event of willful misconduct or fraud on the part of Bethera, including, but not limited to: damages for loss of profits, damages for misuse, indirect losses, any tangible or intangible loss resulting from the use of the service or any other consequential damages of any nature whatsoever.
  8. Bethera also disclaims any liability for any failure or delay due to force majeure, including but not limited to war, terrorism, state of emergency or disaster (including natural disasters), computer virus infection, bugs, alterations, unauthorized interventions, technical failures, affecting the performance of its obligations under this Agreement.
  9. The User or third parties may not hold Bethera liable in contract, tort, criminal or any other way for any modification or alteration of prices, suspension or termination of the service.


RESTRICTIONS ON THE USE OF THERABOX

When using Therabox, the User undertakes not to:

  • Use any mechanism, computer program or technology to interfere or attempt to interfere with the normal operation of the same;
  • Send or transmit illegal, fraudulent, defamatory or obscene information to Therabox;
  • Sending or transmitting to Therabox information that contains viruses or bugs;
  • Publish, represent, distribute, create derivative works from, reproduce or use the content of Therabox (excluding express and previously permitted use);
  • Sending or transmitting information that violates the intellectual property rights of third parties;
  • Undertake any activity that places excessive strain on Therabox's infrastructure;
  • Inserting, hosting, uploading, transmitting or sending unsolicited "spam" messages (a "message" means any email, sms or data entered into the system);
  • Display any part of Therabox's content through the use of framing, links or other technology without the express written permission of Therabox.


PAYMENTS AND REFUNDS

  1. Users can try it out for free with no cost. This trial period does not include billing and SMS services.
  2. The service is charged in advance and according to the periodicity contracted (monthly or annually). There will be no right to a refund or credit whenever (i) the service subscription is canceled, (ii) the subscribed plan is upgraded, or (iii) there are periods of time without using Therabox or without access to the Personal Area.
  3. The User must pay for the contracted service by ATM reference. The prices associated with the service subscription are shown in Euros and include the VAT rate in force.
  4. With the new version, prices will be adjusted according to the new table.
  5. For customers who will be renewing, the conditions will be presented by the sales team


DATA IMPORT

The import file is a CSV file and is available on Therabox in the Customers/Patients tab. Patient data is imported by the user. The only field that must be filled in for the import to be successful is the Name field.

The data that can be imported is Name, Date of Birth, Gender, Mobile, Telephone, Email, Address, VAT Number, Identification Document Number, Health System Number, Social Security Number, Nationality, Postal Code, City, Country, District, County, Referral, Diagnosis, Referral Date and Client/Referral Number.

Note: The user must split the import file with 100 contacts.


USE OF SMS

Each notification sent on Therabox, in SMS format, can be up to 160 characters long.

Users should note that:

  1. The symbols ("enter", ^, {, }, \, [, ~, ], |, €) count as 2 characters. When these symbols are used, each SMS can only be up to 140 characters long.
  2. If the User uses special characters (ç, â, ã, etc.), each SMS can only be up to 70 characters long.

In cases where symbols and/or special characters are used that exceed the character limit, more than one SMS may be charged to the User's account.


CHANGE OF SENDER

The name of the sender of SMS messages sent goes with the Therabox name. The sender can be personalized with the name or brand (the chosen name can have a maximum of 11 characters, due to the general restriction of the operators)

Changing the sender has an additional cost of €20.


BLOCKING THERABOX ACCOUNTS

In the event of non-payment on the deadline for renewing the Therabox subscription, access to the platform will be blocked at the same time as the previous payment for the subscription. (Example: You paid at 11:11 on 11/10, so access to your account will be blocked at 11:11 on 11/11, in the event of non-payment.)

In cases of inactivity, if the User does not access their account for a consecutive period of 1 year, for security reasons, Therabox will automatically delete the account and all its history.


FIDELIZATION

Therabox is a service that can be subscribed to on a monthly or annual basis and does not require a contract and/or a loyalty period.


TRAINING

Users have access to Therabox training videos via the YouTube channel (https://www.youtube.com/channel/UczDzEq-pwi-nPE0X5rCWx3g). If you need online or face-to-face training, you should request a quote from the Therabox sales team.


SUPPORT

Support is free and is included in the Therabox Subscription.

Functional Support - Clarifies doubts about the use of Therabox's functionalities, so the user should contact the commercial support team for this purpose.

Technical Support - Requested when the user finds errors in the Therabox database that require the intervention of a specialized technician to resolve.


TRAVEL

Travel (more than 30km from the Bethera facilities) requested by the customer is charged separately, and the cost of such travel is €0.36 per km.


SUBSCRIPTION UPSELL

The upsells are made by the user on Therabox, and the additional value of each upsell made by the user is paid by ATM reference.


USER SUGGESTIONS

Whenever you wish, you can send suggestions for improving Therabox to [email protected] or [email protected]. These will be evaluated by the team and implemented if necessary, and the user will be informed accordingly.


CUSTOM DEVELOPMENTS

Users who want custom developments will need to have their own Therabox environment, which will require the purchase of their own server.

Bespoke developments are charged separately from the Therabox subscription, so the user should contact the sales team for a quote. Once the requirements have been received and collected by the sales team, an effort assessment is carried out and the respective quote is presented to the client, as well as the expected delivery time.


BUG FIXING AND VERSION UPDATES

New features may be included in Therabox through updates and/or new versions made available, and old features may cease to exist and/or suffer limitations.


CHARGING AND EXTRA COSTS

Therabox only makes the extra purchased available after payment of the ATM references sent to the user, with the exception of the Billing module.


SAF-T EXPORT vs AUTOMATIC COMMUNICATION

The Therabox user, with the Invoicing module purchased, is responsible for exporting the SAF-T and delivering it to the Finanças website.
